Since 1993, tax advisors have relied on a statement from Inland Revenue that costs from unsuccessful software projects could be immediately deducted. This position, however, become less certain earlier this year when Inland Revenue stated that in its view only expenditure incurred in the feasibility phase of a failed software project could be deducted for tax purposes. This statement created significant uncertainty about the deductibility of research and development expenditure in the IT sector.
